1. The controller of your personal data collected via the website is EFEKTA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ WITH ITS REGISTERED OFFICE IN WARSAW, NATIONAL COURT REGISTER (KRS) NUMBER: 0000531591, hereinafter referred to as the “Controller”.

2. The Controller shall process your personal data in accordance with the provisions of this Policy and the applicable data protection legislation, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, hereinafter referred to as “GDPR”.

Conducting correspondence via the contact form

4. The Controller processes your personal data in accordance with the applicable legislation, for the purpose of conducting correspondence in response to your message sent via the contact form. The Controller conducts correspondence via e-mail with the following natural persons who sent a message to EFEKTA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ via the contact form. Personal data of persons who filled in the contact form is processed for the purpose of establishing contact, replying to the sent enquiry, further correspondence and possible presentation of an offer in the area covered by the subject of the conducted talks (only and exclusively after a previously expressed request for such an offer!). Personal data within the scope of the contact form are processed on the basis of Article 6(1)(f) of GDPR – in order to realise the legitimate interest in the form of sending a response to your enquiry and conducting direct marketing operations. Consent to receive commercial information by electronic means, which you may receive as part of the correspondence conducted in response to the message sent by the contact form, constitutes consent to receive commercial information within the meaning of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws 2002, No. 144, item 1204). Accordingly, the Controller shall obtain consent for the above operations from the persons with whom correspondence is being conducted. We apply all consent collection requirements set out in GDPR and the aforementioned Act.

5. The scope of personal data processed by the Controller may include the following personal data of the person who provided it directly to EFEKTA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, mainly:

  • name;
  • surname;
  • e-mail address;
  • other personal data provided voluntarily in the contact form or in any other form of communication addressed to the Controller (primarily the data indicated to us in the fields of the form: choice of city/subject/content of the message).

6. Individuals whose personal data is processed by the Controller have the following rights:

  • The right to request access to your personal data;
  • The right to request the rectification of previously provided data;
  • The right to request the erasure of previously provided data;
  • The right to restrict the processing of previously provided data;
  • The right to request the transfer of previously provided data;
  • The right to object to data processing.

WHAT ARE THE ENTITLEMENTS?

The right of access to your data and the opportunity to obtain a copy of your data (you will be provided with a copy of your personal data if you request it in advance, for which a reasonable fee may be charged based on administrative costs);

The right to rectification of processed data (you have the right to request the immediate rectification of personal data that is inaccurate and, furthermore, taking into account the purposes of the processing, you have the right to request the completion of incomplete personal data, including by providing an additional statement);

The right to request the erasure of the processed data (you have the right to request the immediate erasure of the data when:

  • the data is no longer needed for the purposes for which it was collected or otherwise
  • processed;
  • you withdraw your consent, which is the basis of the data processing;
  • when you raise an objection to the processing and there are no overriding legitimate grounds for processing;
  • the data has been unlawfully processed;
  • the data should be erased in order to comply with a legal obligation under Polish or European law). However, the above will not apply if the processing of your data is to:
  • exercise the right to freedom of expression and information;
  • comply with a legal obligation requiring processing under European or Polish law;
  • establish, assert or defend claims. The right to restrict processing You are entitled to request the restriction of processing in the following situations:
  • when you question the accuracy of the data (for a period of time allowing you to check the accuracy of the data);
  • when the processing is unlawful;
  • the Controller no longer needs personal data for the purpose of processing, but it is necessary for the data subject to establish, assert or defend against claims;
  • if you object to the processing (until it is determined whether the legitimate grounds on our side override the grounds for the objection). The right to data portability (to another data controller or directly to you to the extent set out in Article 20 of GDPR – in a structured, commonly used machine-readable format The right to object (you have the right to object at any time to the processing of your data for direct marketing purposes, including possible profiling; in this situation the Controller will not be entitled to process your data unless the Controller demonstrates the existence of:
  • valid legitimate grounds for their processing which override your interests, rights and freedoms, or
  • grounds for establishing, asserting or defending the Controller’s claims.

7. The data subject has the right to lodge a complaint with the supervisory authority if they consider that their rights are not duly respected and implemented. Beforehand, however, we recommend that you take up correspondence at the Controller’s e-mail address that we have indicated to you above.

8. The Controller shall keep personal data for the period necessary to fulfil the purpose for which they are collected, i.e. for the following periods:

  • for the time necessary to correspond with the Controller as part of an enquiry made via the contact form;
  • for the duration of the marketing operations carried out or until you object to further processing for marketing purposes;
  • other deadlines resulting from legal regulations (refers to data necessary for the fulfilment of legal obligations incumbent upon us). We inform you that EFEKTA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ processes data to the extent necessary to fulfil the aforementioned purposes of processing. Where there is more than one purpose, the relevant retention period is the longer period. The Controller may in the future be entitled to process personal data for the period necessary to pursue another legitimate interest (e.g. possible recovery of claims). The Controller shall also not be entitled to continue processing personal data in the event that the data subject withdraws consent to the provision of electronic services. However, the above will not affect the lawfulness of the existing processing of personal data.

9. The Controller shall process personal data in a manner that ensures its integrity and confidentiality.

1) We would like to inform you that the Controller stores cookies.

2) Using our website means that they will be placed on the device you are using. You can change your browser settings at any time.

3) Cookies are understood to be IT data, in particular text files, stored on the users’ terminal equipment (such as computer, phone or tablet) and transmitted by websites. If no changes are made, the user shall be deemed to have consented to the website’s use

of cookies.
